We have Office E3 License, and I have possibility for create model-driven application with cds. https://docs.microsoft.com/en-us/power-platform/admin/pricing-billing-skus#power-appspower-automate-for-office-365 This is fine?
I understand only PowerPlan for app or for user has this possibility.

we see the same, if a user with only an E3 license, no premium per user/per app/per flow and no trials in the environments, the user can create model driven apps once they have access to they environment with a DB.
Did you ever get a satisfactory answer to this?
Exactly, I have this problem: I have an user with only Office E3 License, without Power Apps Trial. However, he can create model-driven apps.
This is causing a lot of problems with the governance plan.
This problem appeared about 15 days ago. Here are the steps to reproduce it:
1. Acquire a trial subscription of Office E3 https://signup.microsoft.com/create-account/signup?OfferId=B07A1127-DE83-4a6d-9F85-2C104BDAE8B4&dl=ENTERPRISEPACK&culture=en-US&country=US&ali=1&products=cfq7ttc0k59j:0009
2. With a Global Admin account and a Trial Power App license (take one from maker.powerapps.com/trial), create a CDS in the default environment.
3. Create new user with Office E3 license only. Login to make.powerapps.com and try to create a model-driven app. This does not require license.
4. Get a list of users and licenses from https://powerapps.microsoft.com/lt-lt/blog/view-user-licenses/
5. Verify that the new user only has Office E3.

The Office E3 License does not allow you to create model-driven apps. Are you saying that you are technically still able to create a model-driven app? This could be because your user has a trial Power Apps license which allows this. A trial Power Apps license can get assigned to you automatically if you try create a model-driven app.
